Penalties for child sexual abuse vary according to the specific offences for which the offender has been convicted. Criminal sanctions may include imprisonment, fines, registration as a sex offender, and restrictions on probation and probation. Civil penalties may include liability for damages, injunctions, involuntary liability and for perpetrators associated with their victims, loss of custody or parental rights. States have also passed laws that instruct law enforcement officials on how to respond to intimate violence. The U.S. Department of Health and Human Services` Administration of Children & Families operates the Child Welfare Information Portal, which includes mandatory reporting information as well as specific state laws. Individuals or professionals who are looking for information about their state`s reporting laws are always advised to refer to their state`s government website for specific legislation. Due to the increased media attention on child sexual abuse, many laws should be enacted to appoint additional professionals as mandated journalists or to engage all citizens as commissioned journalists. However, in most of these states, the employer may require a medical certificate or other proof of injury. (These states require the employer to keep this information secure and confidential.) [12] These crimes are most often dealt with by family courts rather than criminal courts, although there is no law prohibiting simultaneous proceedings in both instances. [13] A related offender, if convicted under the state`s incest law, will receive a significantly lower sentence for committing the same acts that constitute criminal child sexual abuse in that state. [14] Recognizing this shortcoming, some states have amended their criminal laws to prohibit the prosecution of intrafamilial child sexual abuse under incest laws.
